In a disturbing audio clip, Ed Brown speaks for the first time since his arrest and relates how he was gassed by noxious fumes for three days in a detention center as well as being put in a deprivation tank for 15 hours.

Shaun Kranish of MaketheStand.com was able to call the Ohio prison that Brown has been incarcerated in and talk with him on the phone for 10 minutes.

Sensory deprivation is a form of torture and extended deprivation can result in extreme anxiety, hallucinations, bizarre thoughts, depression, and antisocial behavior.

Brown also said he had been prevented from making any phone calls or receiving mail.



For the first time, Brown reveals what happened when he was tricked and arrested by U.S. Marshals, including how he was tasered multiple times.

Brown said that he had a chance to fight back during the arrest but that he did not want to hurt anyone.

Brown said his captors were treating him with "professional cruelty" and mentioned that they had also done harrowing things to his wife following her arrest, but refused to go into detail.

"I guess Ed and Elaine Brown, the elderly couple, really rattled their cages, we must be a real terror to the federal government, the corporate structure," said Brown.

Following our article about Ed Brown supporters fearing Brown was being mistreated or tortured, U.S. Marshal Stephen Monier dismissed it, saying, "That's absolutely ludicrous."

If what Ed Brown relates in the audio clip is true, it's abundantly clear that he is being cruelly mistreated.

In a related development, Elaine Brown's son David told WMUR News that he has also been prevented from speaking to his mother.

The case of United States vs. Edward and Elaine Brown was not about income taxes. For more than a dozen years, they simply asked the Internal Revenue Service to show them the law that specifically makes them liable to pay the federal income tax, all the while stating that if the government could do so, they would gladly pay all income taxes and never question the law again. Instead, the Internal Revenue Service ignored their requests, year after year, although the Browns were constitutionally entitled to an answer. Then, in 2004, after never responding to any of the Browns’ countless requests, the Internal Revenue Service, along with a SWAT team, US Marshals, state and local police, raided Elaine’s office building and took each of the Browns, by force, into custody.

“In all criminal prosecutions, the accused shall enjoy the right… to have compulsory process for obtaining witnesses in his favor…”

Elaine Brown, representing herself and her husband, Ed, hand crafted over fifty motions during the course of their trial. All legal experts who read the motions agreed that they were flawlessly written and all within the scope of the law and in accordance with established court procedures. All but a handful of the motions were denied, many without objection from the prosecution or without explanation. The Browns were not allowed witnesses, to present evidence, or to cite case law. The jury was also instructed to return a verdict based solely on whether or not the Browns paid federal income taxes or filed tax returns for the years in question. Also, the Browns were technically not charged with a crime, they were charged with two penalty clauses. No indictment ever cited a statute that showed the defendants liable to pay an income tax or file a tax return.

Due to the fact that the Browns’ constitutionally guaranteed rights were not honored, they now sit in prison, separated from each other. Their livelihood has been taken away, their property confiscated, and they have been financially destroyed. When they are finally released from prison, they will be homeless, penniless, unemployed, and in their seventies. No government employee, or public servant, has yet answered their question and showed them the law subjecting them to a federal income tax on their wages.

The Browns are being destroyed for asking a question. Furthermore, the Internal Revenue Service is illegally confiscating over three million dollars worth of property and assets for an alleged, and unproven debt of only six-hundred fifty thousand dollars. Our servant government is obligated to answer their question, but rather they locked them up and destroyed their lives. This is unacceptable.

We hereby petition the United States government, specifically the United States Federal Court of Appeals, 1 Courthouse Way, Boston, Massachusetts, to reconsider the appellate denial of Edward Lewis and Elaine Alice Brown. We also petition the United States government to cease the seizure of the Browns’ properties and assets until such time that a fair trial, as defined by the United States Constitution, can be executed.

Several years ago his well was ruined during a road-blasting project on Hwy G adjoining his property. He could not afford to drill a new well. Later, in 2000, a mail mix-up made it appear to Richland County that his taxes were delinquent. While arguing with the county about that, he sent them a bill for $5,000 to replace his well. The county refused reimbursement, so he did not pay taxes from 2000 to 2006, an amount of $6,509.44 plus interest.

On March 31, 2008, authorities attempted to serve eviction civil process papers. Bayliss responded with warning shots. April 3, 2008, at 9:01, a.m., authorities from all over the state attempted an assault with an armored Bear Cat. The 60-year-old Viet Nam navy sonar technician held his ground. At 4:52 p.m., a third assault with three Bear Cats, a helicopter, plane, IR camera, and PA system deployed firearms and teargas. Bayliss surrendered after his house caught on fire. No injuries were sustained, but the three Bear Cats were damaged. The FBI and BATF were on the scene to secure and clear the area.

Gerhard began visiting the Browns' home in early 2007 to do research for his community college newspaper and spent several weeks there during the summer, according to trial testimony.

The four men were arrested in September. In October, a small team of U.S. marshals posing as supporters arrested the Browns without incident on their front porch and took them to separate prisons.
